Musk’s China Trip Sparks Apology During OpenAI Trial

Elon Musk’s lawyer apologized to a U.S. court Monday for the CEO’s absence during critical proceedings in OpenAI’s corporate governance trial, citing Musk’s simultaneous business trip to China. The trial, which examines disputes over OpenAI’s transition from a nonprofit to for-profit entity, entered its second week with Musk’s testimony deferred amid his international travel schedule.

According to CNBC, Musk’s legal team explained his absence as part of “urgent business commitments” in China, where the billionaire entrepreneur has recently expanded Tesla and xAI operations. The court was informed that Musk planned to return for later stages of the trial, which involves claims from former OpenAI executives over alleged breaches of fiduciary duty.

OpenAI, the San Francisco-based artificial intelligence research laboratory, faces legal challenges related to its 2019 restructuring and governance decisions. The case has drawn attention as it could set precedents for corporate accountability in AI development. Musk, who joined OpenAI’s board in 2018 before becoming a major investor, maintains he acted in the organization’s best interests.
