Altman Expected to Testify as OpenAI Trial Resumes in Oakland

OAKLAND, Calif. — OpenAI CEO Sam Altman is expected to take the stand as the trial pitting Elon Musk against OpenAI resumes in an Oakland federal courtroom, according to NBC Bay Area.

Altman’s testimony is expected to address OpenAI’s governance structure and its transition from a nonprofit to a for-profit entity, central issues in the case.

Musk, who co-founded OpenAI as a nonprofit research organization in 2015 before departing its board in 2018, has alleged that the company abandoned its original mission to develop artificial intelligence for the benefit of humanity. The lawsuit has centered on whether OpenAI’s shift toward a capped-profit model violated its founding principles and commitments to its early backers.

Altman has overseen OpenAI’s transformation from a research lab into one of the most valuable technology companies in the world. Under his leadership, OpenAI developed ChatGPT and secured billions of dollars in investment from Microsoft Corp. and other backers.

The case addresses questions of corporate governance and the obligations of nonprofit organizations that pivot to commercial enterprises.

OpenAI has previously defended its restructuring as necessary to attract the capital required to pursue its mission of building safe artificial general intelligence, arguing that the nonprofit model was insufficient to fund the computational resources modern AI development demands.
