Musk Returns for Second Day of Testimony in AI Lawsuit

SAN FRANCISCO — Elon Musk testified for a second consecutive day this week in his lawsuit against OpenAI, with proceedings touching on corporate governance, nonprofit conversions and the commercialization of artificial intelligence research, Yahoo Finance reported.

The continued testimony is part of Musk’s legal battle with OpenAI, the company he co-founded and later departed. Musk has alleged that OpenAI abandoned its original nonprofit mission to develop AI for the benefit of humanity when it shifted toward a for-profit model and entered into a multibillion-dollar partnership with Microsoft Corp.

The case has evolved through multiple amendments and legal maneuvers since Musk first filed suit, drawing attention from the AI industry, investors and policymakers over questions of fiduciary duty and the governance of AI organizations, the report said.

According to the report, a ruling favorable to Musk could call into question the for-profit conversions that several AI research labs have pursued, while a decision in OpenAI’s favor could affirm the latitude companies have in restructuring to attract the capital needed for large-scale AI development.

The case also carries implications for Musk himself, who leads AI venture xAI, which competes directly with OpenAI in developing large language models. Critics have argued that Musk’s legal challenge is at least partly motivated by competitive interests, a characterization Musk has disputed, according to the report.

Legal experts cited in the report noted that the outcome could influence how courts treat governance obligations of AI organizations, particularly those that began as nonprofits or received tax-advantaged donations under a charitable mission.
