Commercial insurer Embroker sells tech-liability cover with no AI-specific policy language, named carrier or coverage limit

Embroker's Technology E&O/Cyber policy covers many AI failure modes without naming AI. No underwriting carrier or coverage limit is published.

Embroker, a commercial insurance brokerage serving startups and technology companies, sells a policy that would cover many of the failure modes an AI product could cause — but names no carrier, no coverage limit and no AI-specific policy terms, according to a review of embroker.com by AI Dispatch. That puts it in a different category from purpose-built AI insurers such as Armilla AI and Munich Re's aiSure, which name AI failure explicitly in their own policy language, as AI Dispatch has previously reported.

The relevant product is general technology liability, not an AI-specific line. "Technology Errors and Omissions / Cyber Covers liability claims that allege financial losses arising from your tech products or services, and costs arising from a security breach (ransomware, system damage, etc.)," the company states. Broader marketing copy aimed at startups describes similar protection without naming AI: "Comprehensive coverage against liability claims, cyber threats, alleged discrimination, and other common startup risks." Embroker's homepage also lists "protection against data breaches, on-site accidents, professional errors and omissions, and more" among its general business lines.

Embroker reports a substantial book of business — "16k+ Policies secured 9.5k+ Businesses protected 10 years Serving customers," according to the site — and cites third-party recognition: a "4.5 AdvisorSmith rating."

What the page does not name is specific to how a claim would actually pay out. AI Dispatch's index records no coverage limit, no named underwriting carrier and no AI-specific regulatory or risk language on the page reviewed — each logged as "no public information." A startup buying Embroker's tech E&O policy to cover an AI product's failures would be relying on a generic liability framework never written with AI failure modes in mind, from a broker that does not disclose which carrier ultimately bears the risk.

The insurance and liability layer AI Dispatch tracks includes both kinds of company: insurers that write AI risk by name, and general commercial brokers whose existing products happen to reach it without naming it. Distinguishing between the two is the point of citing policy language directly rather than the marketing category.
